AC, for some reason, I can’t seem to download the DSC today. All my other podcasts (I have like 100 subscriptions) download fine, but the DSC gets maybe the first minute, and than stalls. Anybody else experiencing this?

Hey Adam, the stuff today about ‘Talkers’ and ‘Doers’ was just GREAT – one of the best thinks I ever heard.
But be careful about your ‘therapie’ – consult a lawyer first. ‘Van de Linde’ (?) may not be seen as a ‘person of public interest’ like you and your wife. You will probably end up paying this guy a lot of money because of this.

I agree with you on your point of the tabloids using your photos illegally for commercial use. They blatantly violated the Creative Commons License.
Now I am a dad also so I understand why you are pissed off, but I think it would be difficult to make a case for endangerment of your daughter considering those photos were put in a public site like Flickr. If the tabloids put her in danger wouldn’t a judge say you did the same thing by putting her pictures on a public website where the world can see them?
But if they are stalking her, go for the jugular dude. I still support you on this.

Anyway I wanted to comment about ‘doers’ versus ‘talkers’ and about nations as a whole, not as individuals, where I will show that UK = doers and Netherlands = talkers. So: there is a May 1st 2004 and after 40 years of occupation by fucking soviets, some eastern European countries join EU (European Union). What does UK ? UK opens itself fully for new EU citizens. What does Netherlands: it closes itself (it can close itself by 2011 – later it would have to leave EU to stop new EU citizens). Now we have May 1st 2006 coming and the 2 year review period is coming and Spain, Finland and Portugal are opening itself to new EU citzens (while UK, Ireland and Sweden did it already previously). What is Netherlands doing on May 1st 2006? It is saying that it will stay closed. What the fuck is with Dutch openenss and lack of racism? This is big lie! Netherlands is full of talk when it comes to being European etc but facts and deeds show otherwise. So my compatriots helped freeing Netherlands from Nazis in Operation Market Garden and these fuckers now treat them as shit by imposing limits on them? So fuck you Netherlands and starting now I am effectively boycotting all products that have “Made in Netherlands” on them. I will not buy them anymore. Fuck you very much, Dutch!

Great show, totally with you, as a professional photographer (among other things). Fairly new to the Charlie (which I evidently understand the name of better than madge) and I haven’t gotten everything figured out yet, Not sure how people submit audio comments, and whatnot, but I will figure it out. Love the show, however, it’s replaced radio as my weekday morning listening material. By the way, the british government can take 100 pounds from me, I’d be downright skinny if they took that…
Adam that was awesome! However, be catiuos when you do a thing like this. For example, make sure to mention that you nor the contest will accept any illegal behaviour, only legally taken pictures…. And also, make sure you consult a lawyer for obvious reasons, otherwise this might cause a backlash…
Anyway, a comment about the fact that the judge ruled less hard because the pictures was taken on a vacation: This actually does matter, because the originality and “artiness” of a picture or song does matter.
In the Swedish law we have something called “height of artwork” or “verkshöjd” wich refers to a couple of criterias:
a) is the artpiece original? To wich degree?
b) Basically, a very “arty” song, such as classical music, is considered more valuable and therefor in some cases have a stronger protection.
So for example, classical music actually gets a higher compensation from radioplays, and is not permitted to perform without the authors consent.
The same argument does apply to pictures. Now, I’m not an expert in international law and definitely not dutch law…. just a thought. peace

I agree as an emigrated Dutchman that from the outside Holland is all happy and a great place, but there are indeed things not 100% there, like the judges misunderstanding of the values of the internet…

In all seriousness, in regard to your photography contest – I think that it would be important for everyone to recognize that neither the DSC, you individually, or Podshow, want anyone to get hurt over this, and that all pictures should be taken in public places at appropriate times and all interactions should comply with whatever applicable laws and those of good taste.

Lazy Adam lazy. Again you make one sided arguments without talking about the whole issue. What we were fussing about was you pushing it off as a show by two girls who had a desire to podcast and were lucky to get sponsored by Accuvue. They were created by Accuvue. That is a big difference than being just underwritten by them. I know you have no problem with corporations creating “fake” shows like they do with cookie-cutter bands that you supposedly rail against radio for.
I’m sorry but it’s becoming evident more and more everyday that you are part of what we (podcasters in general) are reacting against. You are part of machine. All that talk by Ron Bloom on Podcast411 about conforming to Madison Ave. expectations!? Aren’t we supposed to be starting a revolution? Isn’t that what you talk about? I loved your rant about talkers vs. doers. I am a big fan of people getting off their rears and being productive in some way.
I’d also like to add this note : While I think most consumers respect and appreciate… even admire producers, there are some who resent them… because the ‘doers’ illustrate the fact that the only reason the ‘talkers’ aren’t having equal success… is that the talkers are lazy. It makes them face the fact that their lives are their own fault, so they resent it. Not all consumers, but that small minority of consumers who are also talkers, if you see what I mean?
Regarding the two tiered Internet thing… while, yes, it infuriates me and I’m doing what I can to oppose it, it’s hard for me to get too worked up and shocked about it. This is not a new thing. It’s just another battle in a very old war that too few people know about. To give an idea of how long this nonsense has been going on, I suggest doing some research on a group called “COSUARD”, that stands for “Coalition Of Sysops and Users Against Rate Discrimination”.
Even back in the late 1980’s and early 1990’s, this sort of thing was going on, and was pursued pretty aggressively. Maybe it’s time for that spirit to be reborn. Perhaps a “Coalition Of Producers And Consumers Against Rate Discrimination”? Hmm COPACARD doesn’t really have the same ring to it, but the name isn’t the important thing…. I’ll see what I can come up with for a website. Maybe include forums for defending copyrights and protecting the ’small’ producers for the big corporates…

I really think you should appeal as I think the judge made a grave mistake. I don’t think it’s right that you can steal someones “art” i.e. pictures or music for a small fee. However if this IS the case in the Netherlands I will continue downloading music and films illegally and I have firm confidence in an eventual courtcase.
Adam, about the $400,000 that it cost for the MTV case after the “settlement”. Did you lose, or was this the fee for the 2 million you won and is the take for the lawer, leaving you with say 1.6 million. Please, more facts!
1. Yes, absolutely appeal. What they did is a clear violation of Flickr’s EULA, and should be held up as such.
2. If you really wanna get back at the tabloids, play their game: offer a reward for the worst-looking, dumpiest, most miserable looking picture of this guy on top of the two you’re offering now.

Although you will most likely not respond to this, I would still like to add something to your comment about other people’s comments on the fourms and boards.
First, I applaud you not blaming podcast pickle itself.
Yes, it is true that people have said some irresponsible things and made outlandish personal attacks on some forums. You have a right to criticize those personal attacks. Those who rely on personal attacks greatly weaken their credibility. They also do not deserve a response.
You have the right to voice your own opinion and disagreement with those who oppose what you do or what you say. It makes sense. This also, however, applies to those who disagree with the Acuvue sponsored podcast. They too can have an opinion and should not be personally attack or generalized.
It saddens me that you would choose to not particpate in the forums because of these events. And, a large part of me understands why. However, part of what makes podcasting such a good thing is community and a large part of the community environment are the boards.
Whether you now choose to be or not, and whether others want it or not, by being a large figure in the podcasting world, it may be a better idea to set an example on the forums rather than criticize them. Ignore the personal attacks and voice your arguments. This, afterall, would go along the idea of doers instead of talkers.

When I returned to the Netherlands in 1984, I had lived in the States before, I said to my Dutch Uncle that I had a card, were I could get money out of the wall and I said that we had cable television and had a channel which showed music video and was called MTV. He said to me That’s not possible and it’s wil only happen in Amereica and is very silly. This is why I hate my own country, no imagination and you can’t be special or different at all. It’s to bad Adam that the lawsuit went the way it did, but let’s move on. It’s very clear to me that England is the right coutry for you to live in. For the last bloody time, it is not a UK half-term holiday.
Scotland has a proper holiday at the beginning of April (as Education is a devolved matter), having had a Half-Term in mid-February. To my knowledge, as someone who’s lived in the UK for my whole life, England and Wales have a similar system.
I was disappointed to hear you wanting revenge on the magazine by encouraging others to do to the editor exactly what he did to your family. I thought you’d be above that. Yes, it’s human nature, but not one of our nicer traits for sure. You’ve encouraged people to put energy into many good causes, but this doesn’t seem like one of them.
